EMBER Limited Terms and Conditions

1. Introduction

1.1 These Terms and Conditions ("T&C") are a legal agreement between EMBER Limited ("EMBER", "we", "us", or "our"), and you ("User" or "you"). This T&C governs your use of the EMBER website, any other designated EMBER site (collectively, "EMBER Site"), and the EMBER application, including all content provided by EMBER through the EMBER Site and application ("EMBER Service"). By accepting this T&C, accessing, or using the EMBER Service, you acknowledge your agreement to be bound by this T&C and the referenced Privacy Policy. If acting on behalf of an entity, you confirm authority to bind said entity and its associates to this T&C.


1.2 To withdraw or reset accounts, Users must complete 40 data entries or booking orders. The minimum reset amount is 100 USDT. Both Users and the platform must maintain confidentiality regarding this platform.


2. EMBER's Obligations

2.1 EMBER commits to protecting the confidentiality, integrity, and availability of information assets. Each mobile number may be registered only once, upholding user exclusivity and security.


2.2 EMBER ensures business continuity and minimizes disruption by effectively managing and responding to security incidents, adopting secure business practices and business management to facilitate continual improvement.


2.3 EMBER ensures that all information control measures are timely, efficient, repeatable, and consistent to benefit users and stakeholders.


3. User and Agent Obligations

3.1 Users and agents are required to complete 40 data entries or booking orders before applying for withdrawal.


3.2 Agents will be given tasks and rewards, including Luxury Deals, which must be completed or achieved within specific timelines. Users/agents cannot cancel, skip or undo booking orders. EMBER reserves the right to take legal action against any person/entity that causes any type of damage to the company.


3.3 Both users and agents must maintain confidentiality and adhere to platform security protocols.


3.4 Users/agents can receive Luxury Deals randomly within one set of applications, with a 2.7% chance per set, and each subsequent deal reduces the likelihood by half. All orders are randomly assigned by the system and cannot be refused by users.


3.5 Agents must complete their set of booking orders before withdrawing commissions and deposits to prevent operational losses. To ensure deposits are credited to the user's account, they must be submitted directly to customer service, providing consistent depositor's name and amount details to expedite processing. Any unresolved issues should be promptly reported to customer service.


3.6 Traffic value allocation is randomized based on the user's account balance. A higher account balance results in a higher traffic price, leading to increased revenue. To withdraw, users must complete all necessary data, with withdrawal requests processed between 10:00 AM and 10:00 PM.


3.7 Users can earn additional commission bonuses by inviting new users to join the platform as agents, amounting to 20% of the referred user's daily commission.


4. Data Protection and Privacy

4.1 Personal data is protected in accordance with applicable laws and encrypted storage and transmission methods are used. Users must provide necessary information for service access and comply with national regulations and identity verification requirements. Persons under the age of 16 are protected by data regulations, and those under 18 must obtain written consent from their guardians before using the platform.


4.2 Users can manage their personal information, subject to security and identification constraints. Under normal circumstances, users may view and modify submitted information at any time, but due to security and identification considerations (such as account recovery services), they may not be able to modify final registration information and other verification information.


4.3 EMBER will employ various security technologies, procedures, and sound management systems to protect users' personal information from unauthorized use or misuse. The final registered mobile number for a new EMBER account will be the same as the existing account.


4.4 Without the user's consent, EMBER will not disclose the user's information to external companies, individual organizations, and individuals, except as required by law.


5. Financial Transactions

5.1 Withdrawals and deposits are regulated, requiring completion of certain activities and verification processes.


5.2 Financial operations adhere to stringent protocols to ensure transparency and security.


6. Information Security Policy

6.1 EMBER is committed to maintaining a robust Information Security Management System (ISMS) compliant with ISO/IEC 27001:2013 standards to ensure documented control methods are used to protect EMBER, its users, and stakeholders.


6.2 EMBER will employ commercially reasonable efforts to protect its systems. However, EMBER cannot guarantee the security of any information transmitted through unsecured networks; users assume the risk. If a breach or violation is detected, EMBER will notify users via customer service to take appropriate protective measures.


6.3 The Information Security Policy applies to:

- All information owned by EMBER and provided by users and stakeholders

- Information in any form - paper, electronic, audio, etc.

- All systems, applications, and infrastructure used to process information

- All EMBER employees, officers, contractors, agents, and affiliated companies

- Third parties with access to EMBER's information assets

- All buildings used by EMBER to house information assets or where employees can access information


6.4 This ensures:

- Information is protected from unauthorized access

- Confidentiality of information

- Integrity of information

- Regulatory and legislative requirements are met

- Any violations are reported and investigated


7. Liability and Disclaimers

7.1 EMBER reserves the right to amend this T&C, with changes effective upon posting on the EMBER Site or notification to users.


7.2 This T&C shall be governed by and construed in accordance with the laws of North America, excluding its conflict of law rules.


7.3 This T&C, including any referenced policies and guidelines, constitutes the entire agreement between EMBER and the user regarding the EMBER Service.
